Terms of use of the online store at http://www.goemotion.bg
- These general terms of use ("Terms") govern the relationship between "GREEN E-MOTION" LTD, hereinafter referred to for brevity as "GO e-motion" as the Supplier, on the one hand, and the Users of the website, buyers of goods located on the website http://www.goemotion.bg, hereinafter referred to for brevity "Users", on the other.
1.1 "GREEN E-MOTION" LTD is a company registered under the Commercial Law of the Republic of Bulgaria with EIC 206783092, with headquarters and management address in the city of Varna, Hristo Popovich Street No. 28, email address office@goemotion.bg, telephone +359897999425.
1.2. The company carries out its activities in accordance with the legislation of the Republic of Bulgaria, including The Consumer Protection Act and the Personal Data Protection Act.
The company owns the rights to the Trademark "GO e-motion" under Register number 0161293N, filed with the Patent Office of the Republic of Bulgaria.
Please read the published General Terms of Use in full before using the informational and commercial services offered on the Site (the Services for short). If you do not accept the Terms stated here, you will not be able to use our Online Store. By using our services, available without registration, it will be an expression on your part that you agree to the Terms.
In connection with the Services provided, GO e-motion.bg processes personal data according to the Personal Data Protection Policy ("Policy"), which is visible and easily accessible on our website.
This document contains information about the activities of "GREEN E-MOTION" LTD and the general conditions for using the services provided by "GREEN E-MOTION" LTD, governing the relationship between us and each of our users.
The confirmation of the General Terms and Conditions is a necessary and mandatory condition for the conclusion of the contract between the User and the Supplier GO e-motion.
- Agree to terms
2.1. The user declares that he is familiar with and accepts these General Terms and Conditions by ticking the box "I agree with the General Terms and Conditions" on the registration form. Before pressing the "Registration" button, you have the opportunity to review and edit the information you provided. You accept that electronic statements to GO e-motion and electronic statements from GO e-motion to you will be considered signed with a simple electronic signature in accordance with Art. 3, paragraph 10 of Regulation (EU) No. 910/2014, with the force of a manual signature. The authorship of these statements will be established in accordance with Art. 13, para. 1 in connection with Art. 13, para. 4, ex. 2 of the Law on the electronic document and electronic authentication services ("ZEDEUU").
- 3. Use of the site's services
3.1. The use of the Services is possible with and without registration. Use of the Services in either case will be deemed an expression of agreement to the Terms.
3.2. Registration is done in person, and registration on behalf of other persons is not allowed. When registering, you are required to fill in the mandatory fields in the registration form (name, email address, etc.).
3.3. You undertake to provide true, complete and up-to-date registration data and to maintain such data. In case of inaccuracy in the data, you have no right to use the Services until it is corrected.
3.4. You are responsible for all actions performed through your account using your username and password for access. You undertake to immediately notify GO e-motion in the event of unauthorized access or the possibility of such unauthorized access.
By accepting the General Terms and Conditions, the User agrees to have his personal data processed on the basis of the contract concluded between him and GO e-motion.
- Responsibilities
4.1. GO e-motion is not responsible for any damages as a result of visiting the Online Store and the information published in it.
4.2. Product information is provided as a feature by the manufacturers. GO e-motion is not responsible for inaccuracies in this specification.
4.3. GO e-motion does not exclude the possibility of errors, inaccuracies or omissions, due to technical or human factors and is not responsible in this regard.
4.4. If, due to technical or human factors, hacking of the site by third parties or misuse of the information on the site without the knowledge of GO e-motion, you notice any irregularities, please report to e-mail: office@goemotion.bg
5. Definitions
For the purposes of these general conditions, the following concepts should be understood in the following sense:
Site – http://www.goemotion.bg and all its subpages.
User/ Customer – means any natural or legal person who has placed an order for the purchase of goods from the merchant, through the electronic store, who has confirmed his agreement with these General Terms and Conditions. In case of doubt regarding the data provided to the customer, the merchant reserves the right to refuse the order/terminate the contract by notifying the customer thereof.
General terms - these Terms and Conditions, which include terms of use and delivery, voluntary dispute resolution, contract cancellation and exchange forms, and any other legally binding information found on the Site.
Personal data - information about an individual - three names, date of birth, e-mail, telephone.
Goods - means any product owned by GO e-motion offered on the website www.goemotion.bg. Each product is marked with its main characteristics and sales price.
Sales contract – a contract under which GO e-motion transfers or undertakes to transfer ownership of goods to the consumer and the consumer pays or undertakes to pay the price for them.
Procedure for alternative resolution of consumer disputes - procedure for out-of-court resolution of consumer disputes, meeting the requirements of this law and carried out by an authority for alternative resolution of consumer disputes.
6. Technical steps for concluding a contract.
6.1 Users mainly use the interface of the GO e-motion page to conclude contracts for the purchase and sale of goods offered by GO e-motion.
6.2. The contract is concluded in Bulgarian.
6.3 The contract between GOe-motion and the User represents the present general conditions, available at: http://www.goemotion.bg.
6.4 The party to the contract with GO e-motion is the User according to the data provided during registration and contained in the User's personal profile. For the avoidance of doubt, these are the details with which a GO e-motion account was created.
6.5 This contract is considered concluded from the moment of confirmation by the User, made by opening a confirmation link sent by GO e-motion by e-mail to the User/Client, after the latter has registered on the site and entered a password. In cases of access to the services of GO e-motion without registration on the site, the conclusion of a contract is considered by the parties to be the confirmation of the order placed on the site by the User/Client.
6.6 When placing an order (with or without Registration on the site), the User receives confirmation by email that his order has been accepted. Before sending the ordered goods, GO e-motion has the right to contact the User on the phone specified by him, in order to specify details of the order and/or delivery.
6.7 GO e-motion is not responsible for failure to fulfill an order in cases where the User has specified false, incomplete and/or inaccurate data.
6.8 The statement of conclusion of the contract and the confirmation of its receipt are considered received when their addressees have the opportunity to access them.
6.9. Every order sent through the site will be considered regular by GO e-motion if a username and password that the system has accepted as valid are used, regardless of whether they are used by a person other than the holder. It is the User's responsibility to keep his username and password confidential.
7. Order
7.1. If a product is out of stock, GO e-motion reserves the right to refuse the order.
7.2. After selecting one or more goods offered on the GO e-motion website, the User must add the same to his list of goods for purchase. The selection of goods/products from the site is done by clicking on the "BUY" button. In this way, the selected good/product is added to a virtual "CART", which contains information about each product, its quantity and price, as well as the total amount due for the selected goods/products. All customers who are registered in the GO e-motion mobile application benefit from preferential prices. The customer is also given the opportunity to apply a PROMO CODE owned by him, after which the total price of the amount due will be changed according to the customer's promo code.
7.3. After final selection of goods/products that the Customer wishes to purchase, he should click on the "ORDER" button.
7.4. It is necessary for the User/Customer to provide delivery details, as well as payment and delivery methods, and then to confirm the order through the site interface. This can be done by pressing the "ORDER" button.
7.4. When placing an order, the User receives confirmation by email that his order has been accepted.
7.5 In the event that GO e-motion does not have a product ordered by the User and cannot fulfill the Order, GO e-motion undertakes to notify the User thereof.
- GO e-motion has the right to refuse to conclude a contract with an incorrect User.
8.1. GO e-motion has the right to treat a User as incorrect in cases where:
– there is non-compliance by the User with the General Terms and Conditions;
- an incorrect, arrogant or rude attitude towards the representatives of GO e-motion has been established;
- systematic abuses by the User against GO e-motion have been detected.
9. Prices
9.1. The prices of the goods offered are those indicated on the GO e-motion website at the time of placing the order, except in cases of obvious error.
9.2. The prices of the goods include VAT, in the cases in which it is foreseen to charge it.
9.3 GO e-motion reserves the right to change the prices of the goods offered on the site at any time and without notice, and such changes will not affect orders already placed.
9.4 GO e-motion may provide discounts for the goods offered on the site in accordance with Bulgarian legislation and rules determined by GO e-motion. The rules applicable to such discounts are available where the discount is displayed. The "PROMO CODE" option is an opportunity for each customer/user to enter a code provided by GO e-motion to generate a discount. Providing the code can be done in different ways, such as sending by e-mail to the client, advertising campaigns, flyers and others.
Entering the PROMO CODE is done after clicking the button "Click here to enter the code” . After entering it, you should click on the button "Apply Promo Code". Thus, the system will also generate the discount received by the customer in the final price due for payment.
9.5. Each registered user on the site accumulates points with each order. Accumulated points can be applied to subsequent orders by reducing the price of the products in the basket.! We do not have an option to accumulate points
10. Changes
10.1. Typographical errors, color rendering differences, and product design changes are possible.
10.2. Due to the fact that the Services can only be used according to the current Terms, in case you do not agree with them, we do not have the technical possibility to provide you with the Services in the Online Store. If you do not agree with the Terms, you should not use the Online Store. If you wish, you can close your account and terminate the contract at any time.
11. Payment
11.1 When placing an order, payment can be made in one of the following ways:
- Cash on delivery upon receipt of the order.
- Payment on the spot in the physical store;

12. Payment by bank card through virtual POS
12.1 On our website www.goemotion.bg respectively GREEN E-MOTION LTD you can pay with a bank debit, credit or business card with the Visa and MasterCard logo through the virtual POS of a bank serving us, which is DSK AD part of the OTP group.
12.2 Payment by bank card can also be made by generating a unique link for your order from us to you. After you receive the link in your e-mail, you need to click on it to open the bank's payment page.
12.3 The security of payments is protected by means of the security programs of the international card organizations (ICO) MasterCard Identity check and VISA Secure.
12.4 When paying by card through the DSK bank virtual POS, you will need to enter the card number, validity, CVV/CVC. If your card participates in the MKO MasterCard Identity check and VISA Secure security program, you will need to enter a 3-D password.
12.5 We from www.goemotion.bg respectively GREEN E-MOTION LTD we do not collect, process or store card data. All card data is filled in personally by you in the secure payment page of our servicing bank.
12.6 Regardless of the currency of your bank account, the transaction will be carried out in Bulgarian leva according to the current exchange rate of your bank serving you. All prices are final, including VAT.
12.7 In cases where an amount needs to be refunded, regardless of whether it is in whole or in part, and the payment was made by card, we will refund the amount by ordering a reverse operation on the card with which the payment was made within 5 working days.
12.8 From the point of view of security, the maximum amount for card payment is BGN 12,000.
13. Terms, methods and term of delivery
13.1. GO e-motion undertakes to provide conditions for the proper packaging, transportation and delivery of the products so that their qualities are preserved.
13.2. If the User has submitted his order to the office of the Courier Company, he has a period of 5 working days from the date of delivery to accept it. After this period expires, the order is canceled and returned to GO e-motion.
The delivery of the ordered goods is carried out through the following courier company:

The delivery is made to the user's address on the territory of the Republic of Bulgaria, to the office of the courier company/automatic machine, or the order can be picked up from the physical store located in the city of Varna, "G.Benkovski" Str. No..., unless on the website not otherwise specified.
Shipping costs are individually tabulated below. The User pays for the courier services in case of return of goods to GO e-motion, except in the case of wrongly sent goods to the User by GO e-motion.
Before sending the ordered goods, GO e-motion has the right to contact the User on the phone indicated by him, in order to specify details of the order and/or delivery.
GO e-motion is not responsible for failure to fulfill an order in cases where the User has provided false, incomplete and/or inaccurate personal data, including when he has provided an incomplete, inaccurate or fictitious address or phone number.
Delivery is made within the timeframes described under each delivery option in the ordering interface module. In exceptional circumstances, GO e-motion reserves the right to extend the delivery period, promptly informing the User thereof.
GO e-motion processes orders within 2 working days of placing the order, as delays may result from problems with the companies carrying out the logistics, as well as force majeure circumstances related to the Covid crisis, imposing delays and problems with the logistics of the goods. The delivery is usually carried out within the usual period in practice according to the chosen delivery method. It is possible to extend the delivery period due to a temporary lack of a product ordered by you or its insufficient availability to fulfill the quantity requested by you, as well as in the event of a declared state of emergency or an extraordinary epidemic situation. In such cases, we will contact you for further details.
The user is obliged to inspect the goods at the time of their delivery and to notify immediately in case of identified discrepancies, shortages and damages. If the User does not do this, it is assumed that the delivery has been accepted without objection.
GO e-motion reserves the right to change the available shipping and payment methods and/or the terms thereof at any time by posting the available shipping and payment methods on the website without further notice.

"GREEN E-MOTION" LTD provides its customers with the opportunity to choose one of the following delivery methods for goods ordered through www.goemotion.bg:

Deliveries to an address specified by the customer:
In case the order is requested at a Speedy office, the customer has 5 working days from the date of delivery to receive it. An order not received within this period is canceled and returned to stock in "GREEN E-MOTION" LTD, and the amount paid for the order is non-refundable.
*For shipments to smaller towns where Speedy courier company has a specific weekly delivery schedule, the relevant schedule is followed.
**It is possible to extend the delivery period due to the temporary lack of a product ordered by you or its insufficient availability to fulfill the quantity requested by you, as well as in the event of a declared state of emergency or an extraordinary epidemic situation. In such cases, we will contact you for further details.
***We recommend that you track your shipment by the waybill number that you receive by email after the shipment has been handed over to a Speedy courier company.
Deliveries to Speedy offices
When placing an order at a Speedy office, the customer has a period of 5 working days from the date of delivery of the relevant shipment to the office in which to accept his shipment. After the expiration of the period, the order is canceled and returned to stock in "GREEN E-MOTION" LTD, and the amount paid for the order is non-refundable.
To avoid inadvertent errors, after each order, the customer receives an email notification confirming the order placed, to contacts provided by the customer. Courier company Speedy will send the customer an email at the moment the order is accepted by Speedy for delivery, as well as an email/sms on the day of delivery.
Receiving requested goods from the GO e-motion physical store:
"GREEN E-MOTION" LTD provides customers with the opportunity to request delivery of the ordered products from the physical store. This method of delivery is completely free for customers and allows to receive the order easily and quickly at a time convenient for them.
An order not received within 14 days of the in-store delivery date is canceled and returned to stock in "GREEN E-MOTION" LTD, and the amount paid for the order is non-refundable
14. Product Return
14.1. The consumer has the right to return products within 14 days of their purchase if they change their mind for any reason, provided that the product shows no signs of use and is in its original packaging. The costs of returning the shipment are borne by the User. Upon fulfillment of the conditions described above, after receiving the product, GO e-motion undertakes to reimburse the User the amount for the returned product.
14.2. Refunds are made in the manner in which they were received from "GREEN E-MOTION" LTD, unless it is expressly mentioned that the User prefers another payment method. Shipments paid for by the User with cash on delivery are returned to the bank account specified in the User's request to GO e-motion.
14.3. In order to exercise your right of withdrawal, you must notify Us of your name, address, telephone number, email, and of your decision to withdraw from the contract with an unequivocal statement. It is sufficient to send a message regarding the exercise of the right of withdrawal within the mentioned 14-day period.
14.5. If you cancel an order, we will refund all payments we have received from you within 14 days from the date of return of the goods. The deadline is considered to be met if you send the goods back to us before the expiry of the 14-day period. You must bear the direct costs of returning the goods. In case of refusal, the goods must be returned in preserved original packaging, intact and unused. If these conditions are not fulfilled, we reserve the right to refuse to accept the returned goods and not to refund the amount paid by you.

15. Intellectual Property
The intellectual property rights of all materials and resources, trademarks, copyrights, intellectual property rights, etc. located on the GO e-motion website (including available databases) are subject to protection under the Copyright and Related Rights Act , belong to GO e-motion or the correspondingly designated person who assigned the right to use GO e-motion, and may not be used in violation of current legislation.
In case of unauthorized copying or reproduction of information, as well as any other violation of intellectual property rights on GO e-motion resources, GO e-motion has the right to claim compensation for direct and indirect damages suffered in full.
Except in cases where it is expressly agreed, the User may not reproduce, change, delete, publish, distribute and publicize in any other way the information resources published on the GO e-motion website.
GO e-motion undertakes to take due care to provide the User with an opportunity for normal access to the services provided.
GO e-motion reserves the right to suspend access to the services provided. GO e-motion has the right, but not the obligation, at its discretion to delete information resources and materials posted on its site.
16. Termination and cancellation of the contract
GO e-motion has the right, at its own discretion, to unilaterally terminate the contract without giving notice, in case it finds that the provided services are used in violation of the present general terms and conditions, the legislation of the Republic of Bulgaria and generally accepted moral norms.
Apart from the cases provided for in these General Terms and Conditions, the contract between the parties is also terminated when GO e-motion ceases its activity or ceases to maintain its website.
Apart from the cases mentioned above, each of the parties may cancel this contract by giving one week's notice to the other party in case of failure to fulfill the obligations under the contract.
The written form of the contract is considered to be fulfilled by sending a message by e-mail.
17. Conciliation Clause
The parties declare that, in the event that any of the clauses under these General Terms and Conditions is/are found to be invalid, this will not invalidate the entire contract or any of its other parts. The invalid clause will be superseded by the mandatory rules of law or established practice.
18. Amendment of the general conditions
GO e-motion undertakes to notify the Users of any change in the present general terms and conditions within 7 days of the occurrence of this circumstance at the e-mail address specified by the User.
When he does not agree with the changes in the general conditions, the User has the right to withdraw from the contract without giving a reason and without paying compensation or penalty. In order to exercise this right, the User should notify GO e-motion within one month of receiving the message under the previous article.
In the event that the User does not exercise his right to withdraw from the contract in accordance with the procedure set out in these general terms and conditions, it is considered that the amendment has been accepted by the User without objection.
19. Governing Law
The provisions of the current legislation of the Republic of Bulgaria apply to all matters not settled by these General Terms and Conditions.
GO e-motion identifies the Site Users by storing log files on the Site server.
GO e-motion has the right to collect and use information about the Users on the basis and for the purposes of the execution of the contract concluded under general conditions with the User. The information by which the person can be identified may include personal data specified in the general conditions, as well as any other information that the person voluntarily provides during registration. The information includes any other information that the User enters, uses or provides when using services.
GO e-motion takes due care and is responsible for protecting the information about the User, which became known to him on the occasion of the registration, except in cases of force majeure, accidental event or malicious actions of third parties.
GO e-motion can disclose personal data to third parties only in the cases provided for by law and under the circumstances provided for by law or after express consent from the Users.

Consumers can use the European Online Dispute Resolution (ODR) platform available at / http://ec.europa.eu/odr / – a single access portal that allows EU consumers and traders to resolve disputes between themselves .
Alternative dispute resolution (ADR) between consumers and merchants is an out-of-court conciliation proceeding on a voluntary basis.
General conciliation commissions assist in reaching an agreement between consumers and traders in disputes over contracts for the sale of goods and the provision of services.
The general conciliation commissions are determined on a regional basis, and the General Conciliation Commission with its headquarters in Sofia and the area of operation in the territory of the Sofia region is competent to resolve disputes between GO e-motion and the User.
