AGREEMENT FOR THE PURCHASE AND SALE OF AN ELECTRIC VEHICLE

Today in the city of Varna, the present contract was concluded between:

I. SUBJECT OF THE AGREEMENT

Art. 1. The SELLER sells an electric vehicle of the type Electric scooter …………………………………………. serial number ……………………………………

and the BUYER purchases the described electric vehicle referred to in this contract as the EPS.

II. PRICE AND METHOD OF PAYMENT

Art. 2. The selling price of the described electric vehicle (EV) is ………….. BGN including VAT, which amount is paid in cash or by bank transfer upon signing this contract.

III. TRANSFER OF OWNERSHIP

Art. 3. Ownership of the item passes to the BUYER at the time of payment of the sale price according to the terms and conditions specified in Article 2. EPS is non-refundable or exchangeable.

IV. DELIVERY OF THE THING

Art. 4. The SELLER has fulfilled his obligation to hand over the item with its actual delivery when it was purchased from a physical store and with the signing of the acceptance - delivery document /bill of lading from a courier/ when it was also purchased online.

4.1. When selling the item, the SELLER guarantees the serviceability of the EPS.

V. WARRANTY. WARRANTY. DEADLINE.

Art. 5. The SELLER provides a warranty for the EPS for a period of 24 months for the housing and 6 months for the electronics, which includes: the battery, the motor, the controller and the accelerator. The guarantee begins to run from the day of transfer of ownership to EPS as indicated in Article 3 of this contract. By providing a guarantee for the quality of the goods, the SELLER guarantees that the EPS corresponds to the agreed and is suitable for regular use.

5.1. The warranty does not cover defects resulting from:

  • Buyer's fault ie. product damage caused by unqualified repair work, improper assembly, poorly assembled device elements
  • Improper maintenance
  • Mechanical damage
  • Regular use (e.g. wear of rubber and plastic parts, consumables, etc.)
  • An unavoidable event, a natural disaster
  • EPS corrections
  • Improper maintenance, improper placement, damage caused by low or high temperature, water, inappropriate pressure, impact, intentional changes in design or construction, etc.

The warranty does not cover consumables: pads, tires, cables, handles, stands, discs, bearings and accessories.

5.2. The guarantee provided by the SELLER is valid under the terms and conditions specified in Article 5 of this contract if the BUYER fulfills the following conditions:

  • Within the warranty period, the BUYER carries out two inspections of the ECU annually at the center indicated by the SELLER. The performed inspections are at the expense of the BUYER
  • The ESP is charged with an original charger or at the SELLER's Go centers

5.3. Complaint procedure: The BUYER is obliged to immediately notify the SELLER of the damage that has occurred, as well as to provide the SELLER's authorized service center with the EPS for examination, in connection with which the costs of its transportation are at the expense of the BUYER. In case of ascertained damage which is covered by the warranty as well as if the requirements of item 5.2 of this contract are met, the SELLER is obliged to satisfy the warranty claim by repairing or replacing the damaged part within 30 days from the date of its presentation, unless in the specific case requires a longer period, for which the SELLER notifies the BUYER. When submitting the claim, the BUYER is obliged to provide an address for returning the repaired EPS to the address: eshop@goemotion.bg.

5.4. If, after satisfying the warranty, within 30 working days, the BUYER does not look for/take the repaired EPS from the authorized service of the SELLER, the latter will charge a storage fee in the amount of BGN 50 /fifty/ for each day. After the value of the payable storage fee exceeds the value of the item, Green i-Motion Ltd. has the right to retain it.

5.5. In case it turns out that the defect/damage is not covered by the warranty or is due to actions described in Article 5, the costs of establishing the cause of the defect are at the expense of the BUYER. At his request, repairs can be carried out, with all costs at his expense.

VI. SELLER'S RIGHTS AND OBLIGATIONS

Art. 6. The SELLER is obliged to hand over the item under the terms and conditions of this contract.

6.1. The SELLER is obliged to repair the damage within the warranty period under the terms of Art. 5 of the contract.

6.2. The SELLER is obliged to indicate to the BUYER the centers where the latter can carry out the necessary examinations under Art. 5 item 5.2 (for warranty validity) as well as the possibility of charging the battery.

6.3. The SELLER has the right to receive the sale price, as the payment of the price is a condition for the transfer of ownership and for the delivery of the item.

VII. BUYER'S RIGHTS AND OBLIGATIONS

Art. 7. The BUYER is obliged to pay the sale price according to the terms and conditions of this contract.

7.1. The BUYER declares that he is familiar with the conditions of the guarantee as well as with his obligations under Art. 5 item 5.2 necessary for the warranty to be valid. The BUYER also declares that he is familiar with the terms of use of the EPS.

7.2. The BUYER has the right to receive the item according to the terms of this contract.

VIII. GENERAL PROVISIONS

Art. 8. This contract comes into force from the date of its signing.

8.1. Disputes arising from the interpretation, execution or non-execution of this contract shall be resolved by the competent court. When the dispute is not a consumer one within the meaning of the Civil Code on the basis of Art. 117 para. 2 of the Civil Code, the parties designate the relevant court in the city of Varna as competent.

8.2. The provisions of the Bulgarian legislation will apply to the unresolved issues under this contract.

8.3. All amendments and additions to this contract will be made in writing.
